BAUDEMONT SRL establishes this Privacy Policy, the purpose of which is to inform Users in complete transparency of the website hosted at the following address: www.baudemont.be (hereinafter the “Site”), of the manner in which personal data are collected and processed by BAUDEMONT SRL.

The term “User” refers to any user, meaning any natural or legal person, who visits or interacts in any way with the Site.

In this respect, BAUDEMONT SRL determines all the technical, legal and organizational means and purposes of the processing of Users’ personal data. BAUDEMONT SRL undertakes for this purpose to take all necessary measures to ensure the processing of personal data complies with the law of 30 July 2018 relating to the protection of natural persons with regard to the processing of personal data (hereinafter, “the Law”) and with the European Regulation of 26 April 2016 relating to the protection of personal data of natural persons with regard to the processing of personal data and the free movement of such data (hereinafter the “Regulation”).

BAUDEMONT SRL is free to choose any natural or legal person who processes users’ personal data at its request and on its behalf (hereinafter the “Processor”). Where applicable, BAUDEMONT SRL undertakes to select a Processor offering sufficient guarantees regarding the technical and organizational security measures for the processing of personal data, in view of the Law and the Regulation.

2. Processing of personal data

The use of the Site by Users may result in the communication of personal data. The processing of these data by BAUDEMONT SRL, in its capacity as Data Controller, or by service providers acting in the name and on behalf of BAUDEMONT SRL will comply with the Law and the Regulation.

Personal data will be processed by BAUDEMONT SRL, in accordance with the purposes stated below, through:

The contact form;
the use of cookies;
the placing and management of orders made via the Site (order processing, invoicing, payment and after-sales service).

3. Purpose of the processing of personal data

In accordance with article 13 of the Regulation, the purposes of the processing of personal data are communicated to the User and are as follows:

1. ensuring the execution of the services offered and agreed on the Site;
2. ensuring control of the execution of the services offered;
3. carrying out marketing activities and promotional information after the User’s prior consent and until the withdrawal of this consent, for example the sending of promotions on the products and services of the Data Controller;
4. answering the User’s questions;
5. producing statistics in order to improve the website, the services offered and the internal organization of operation;
6. improving the quality of the Site and the products and/or services offered by the Data Controller;
7. allowing a better identification of the User’s centres of interest.

4. Personal data likely to be processed

The User consents, during the visit and during the use of the Site, that BAUDEMONT SRL collects and processes, according to the methods and principles described in this Privacy Policy, the following personal data:

1. The information of Users that they provide for contractual purposes and to allow the proper performance of reciprocal obligations, namely surname, first name, address, IBAN number and bank details, … ; and more generally, any information voluntarily provided by the User;
2. Information of Users by filling in forms or by contacting by telephone, email address or other means, for example the name, address, email address and telephone number of Users.
3. With regard to each of the users’ visits to the Site, the information automatically collected is;
a. the IP address, the type and model of browser, the time zone, the operating system;
b. all information concerning the pages that the User has consulted on the Site, in particular the URL, browsing time …

5. Consent

By accessing the Site and using it, the User declares that he or she has taken note of and has given his or her agreement in a free, specific, informed and unambiguous manner to the processing of personal data concerning him or her. This agreement concerns the content of this Privacy Policy.

Consent is given by the positive act by which the User has ticked the box proposing the Privacy Policy via hyperlink. This consent is an essential condition in order to carry out certain operations on the Site or to allow the User to enter into a contractual relationship with BAUDEMONT SRL. Any contract binding BAUDEMONT SRL and a User regarding the services and goods offered on the Site is subject to the User’s acceptance of the Privacy Policy.

The User consents that the Data Controller processes and collects, in accordance with the methods and principles included in this Privacy Policy, his or her personal data that he or she communicates on the Site or on the occasion of the services offered by BAUDEMONT SRL, for the purposes indicated above.

The User has the right to withdraw his or her consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent previously given.

6. Retention period of Users’ personal data

In accordance with article 13 §2 of the Regulation and of the Law, the Data Controller keeps personal data only for the time reasonably necessary to allow the achievement of the purposes for which they are processed.

This duration is in all cases less than: 24 months, unless a longer duration is necessary to comply with legal, accounting or tax obligations, or to respond to disputes.

7. Recipients of the data and disclosure to third parties

Personal data may be transmitted to the agents, collaborators, subcontractors or suppliers of BAUDEMONT SRL who offer adequate data security guarantees, and who collaborate with BAUDEMONT SRL in the context of marketing products or providing services. They act under the direct authority of BAUDEMONT SRL, and are notably responsible for collecting, processing or subcontracting these data.

In all cases, the recipients of the data and those to whom these data have been disclosed respect the content of this Privacy Policy. BAUDEMONT SRL ensures that they will process these data only for the purposes provided, in a discreet and secure manner.

In the event that the data are disclosed to third parties for direct marketing or canvassing purposes, the User will be informed in advance so that he or she can express consent to the use of these personal data.

8. Users’ rights

a. Right of access

In accordance with article 15 of the Regulation, BAUDEMONT SRL guarantees the User’s right of access to his or her personal data. The User has the right to obtain access to said personal data as well as the following information:

  • the purposes of the processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data have been or will be communicated, in particular recipients established in third countries or international organizations;
  • where possible, the envisaged retention period of the personal data or, where this is not possible, the criteria used to determine this period;
  • the existence of automated decision-making, including profiling, referred to in article 22, paragraphs 1 and 4 of the Regulation, and, at least in such cases, useful information concerning the underlying logic, as well as the significance and the envisaged consequences of this processing for the data subject

The Data Controller may require payment of reasonable fees based on administrative costs for any additional copy requested by the User.

When the User submits this request electronically (through the email address for example), the information is provided in a commonly used electronic form, unless the User requests otherwise.

The copy of his or her data will be communicated to the User no later than one month after receipt of the request.

b. Right to rectification

BAUDEMONT SRL guarantees the right to rectification and erasure of personal data to the user.

In accordance with article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or erased at any time. The User first carries out the necessary modifications himself or herself from his or her user account/other, unless these cannot be carried out independently, in which case the request may be made to BAUDEMONT SRL.

In accordance with article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data have been communicated of any rectification of personal data, unless such communication proves impossible or requires disproportionate effort. The data controller provides the data subject with information on these recipients if he or she so requests.

c. Right to erasure

The User has the right to obtain the erasure of his or her personal data as soon as possible in the cases listed in article 17 of the Regulation.

Where the Data Controller has made the personal data public and is required to erase them under the previous paragraph, the Data Controller, taking account of available technology and the cost of implementation, takes reasonable steps, including technical measures, to inform other data controllers processing these personal data that the data subject has requested the erasure by such data controllers of any links to, or copy or replication of, those personal data.

The previous two paragraphs do not apply to the extent that this processing is necessary:

  • for exercising the right of freedom of expression and information;
  • for compliance with a legal obligation requiring processing under Union law or the law of the Member State to which the data controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller;
  • for the establishment, exercise or defence of legal claims.

In accordance with article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data have been communicated of any erasure of personal data or restriction of processing carried out, unless such communication proves impossible or requires disproportionate effort. The data controller provides the data subject with information on these recipients if he or she so requests.

d. Right to restriction of processing

The User has the right to obtain restriction of the processing of his or her personal data in the cases listed in article 19 of the Regulation.

In accordance with article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data have been communicated of any restriction of processing carried out, unless such communication proves impossible or requires disproportionate effort. The data controller provides the data subject with information on these recipients if he or she so requests.

e. Right to data portability

In accordance with article 20 of the Regulation, Users have the right to receive from BAUDEMONT SRL personal data concerning them in a structured, commonly used and machine-readable format. Users have the right to transmit these data to another data controller without BAUDEMONT SRL hindering this in the cases provided for by the Regulation.

When the User exercises his or her right to data portability pursuant to the previous paragraph, he or she has the right to obtain that personal data be transmitted directly from one data controller to another, where technically feasible.

The exercise of the right to data portability is without prejudice to the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller.

The right to data portability does not adversely affect the rights and freedoms of third parties.

f. Right to object and automated individual decision-making

The User has at any time the right to object to the processing of his or her personal data due to his or her particular situation, including the automation of data carried out by BAUDEMONT SRL. In accordance with article 21 of the Regulation, BAUDEMONT SRL will no longer process the personal data, unless there are compelling legitimate grounds for the processing which override the interests and rights and freedoms of the User, or for the establishment, exercise or defence of legal claims.

Where personal data are processed for canvassing purposes, the User has the right to object at any time to the processing of personal data concerning him or her for such canvassing purposes, including profiling insofar as it is related to such canvassing.

Where the data subject objects to processing for canvassing purposes, the personal data are no longer processed for such purposes.

g. Right to lodge a complaint

The User has the right to lodge a complaint regarding the processing of his or her personal data by BAUDEMONT SRL with the Data Protection Authority, competent for Belgian territory. Further information can be found on the website: https://www.autoriteprotectiondonnees.be.

10. Cookies

The Site uses cookies to distinguish Users of the Site. This makes it possible to provide Users with a better browsing experience and an improvement of the Site and its content. The objectives and methods of cookies are contained in this present article.

a. General principles

A “Cookie” is a file placed temporarily or permanently on the User’s hard drive when consulting the Website, with a view to a subsequent connection. Thanks to cookies, the server recognizes the User’s computer.

Cookies may also be installed by third parties with whom BAUDEMONT SRL collaborates.

Different types of cookies are used by BAUDEMONT SRL on the Site:

  • Statistical and audience measurement cookies: these cookies allow the recognition of the User and are used in order to count the number of Users of the Website over a certain period. 11. Limitation of liability of the Data Controller

The Website may contain links to other websites owned by third parties not linked to BAUDEMONT SRL. The content of these sites and their compliance with the Law and the Regulation are not the responsibility of BAUDEMONT SRL.

The holder of parental authority must give express consent so that the minor under the age of 16 may disclose information or personal data on the website. BAUDEMONT SRL strongly advises persons exercising parental authority over minors to promote responsible and secure use of the Internet. The Data Controller cannot be held responsible for having collected and processed information and personal data of minors under the age of 16 whose consent is not effectively covered by that of their legal parents or for incorrect data – in particular concerning age – entered by minors. Under no circumstances will personal data be processed by the Data Controller if the User specifies that he or she is under 16 years of age.

BAUDEMONT SRL is not responsible for the loss, corruption or theft of personal data caused in particular by the presence of viruses or following computer attacks.

12. Security

The Data Controller implements organizational and technical measures in order to guarantee a level of security appropriate to the processing and collection of data. These security measures depend on the costs of implementation with regard to the nature, context and purposes of the processing of personal data.

The Data Controller uses standard encryption technologies within the IT sector during the transfer or collection of data on the Site.

13. Modification of the Privacy Policy

BAUDEMONT SRL reserves the right to modify this Privacy Policy in order to comply with legal obligations in this area. The user is therefore invited to regularly consult the Privacy Policy in order to take note of modifications and adaptations. Such a modification will be displayed on the Site or sent by email for enforceability purposes.

14. Applicable law and competent jurisdiction

This Privacy Policy is governed exclusively by Belgian law. Any dispute will be brought before the courts of the judicial district of the registered office of BAUDEMONT SRL.
